What this funds

The Digital Equity Act authorizing statute and the resulting grant programs relied on race-based preferences that conflict with principles of equal treatment under the law. At the President's direction, NTIA immediately began the shutdown of the Digital Equity Act programs, while preserving Tribal set-aside funding for Native Entities, which are considered political and sovereign entities, not racial groups, under federal law. In FY 2026 NTIA will launch a new Notice of Funding Opportunity to provide targeted funding to Native Entities. The Infrastructure Investment and Jobs Act established NTIA's Digital Equity programs and provided $2.75 billion in funding. In May 2025, the Administration announced the termination of the Digital Equity Act programs due to reliance on race-based preferences that are inconsistent with constitutional principles. In FY 2026, NTIA will carry out an orderly shutdown of the programs, including termination and closeout of previously awarded grants.
