What this funds

Under the proposed realignment, the functions and resources from Assessments will be consolidated as follows: $3,361,000 and 12 FTE from the Technical Compliance Investigations Division and Accountability Division will shift to the new Education and Training Program while $3,830,000 and 29 FTE from the Civil Penalty Compliance Division, Management Services Division, and Wilkes-Barre Assessments Center will move to Program Administration. The consolidation characterizes the representative structure of all other DOL agencies and aligns with DOL organizational structure. Consolidation of these programs will result in greater efficiency, improved quality, and a more effective central point for services as it supports the In FY 2026, the Office of Assessments (OA) will coordinate timely investigations of discrimination complaints filed by miners under Section 105(c) of the Mine Act. The MSHA enforcement program projects that 92 percent of miners' discrimination complaints will be investigated within 60 days of receipt and 92 percent of miners' requests for temporary reinstatement will be investigated within 20 days of receipt. To ensure MSHA enforcement conducts quality investigations, the OA will review 100 percent of all discrimination investigations that are conducted by the enforcement program staff for discrimination complaints The OA will conduct 15 enforcement field office reviews, concentrating on field offices with cross-over mining operations, during FY 2026. The reviews determine whether MSHA enforcement policies, procedures and guidance were followed consistently. MSHA will conduct an annual Pattern of Violations (POV) screening to identify mines that meet the screening criteria to warrant a review for the issuance of a Notice of POV.
